Legal hurdle cleared for Instant Runoff Voting

IRV Ballot

This week Judge McGunnigle ruled against a lawsuit that sought to halt the use of Instant Runoff Voting (IRV) in Minnesota. The Green Party has long supported IRV as a fairer, more democratic means to elect candidates, so we celebrate this result.

While opponents of IRV are likely to appeal this decision to a higher court, the initial decision sets a strong initial precedent for the constitutionality of instant runoff.

In 2008, the St. Paul city council took an initiative supporting IRV off the ballot after citizens collected thousands of signatures to put it there. The council at that time cited concerns about constitutionality. Will this decision convince the council to step aside and allow citizen democracy to put IRV back on the ballot in 2009?

More information on the decision is available from FairVote Minnesota.
